Terms of Service

1. Acceptance of these Terms

These Terms of Service ("Terms") govern your use of muwasat.com and any associated websites, services, or member accounts operated by Muwasat Association Community Support Group ("Muwasat," "we," "us," or "our"). By accessing the website or creating a member account, you agree to be bound by these Terms. If you do not agree, please do not use the website.

2. Relationship to the Policy and Membership Agreement

These Terms govern your use of the website. The Muwasat Policy and Membership Agreement (effective June 15, 2025) governs your membership in the program and your rights to benefits. Members must agree to both documents. If there is any inconsistency between these Terms and the Policy and Membership Agreement regarding membership, eligibility, contributions, or benefits, the Policy and Membership Agreement prevails.

3. Eligibility

You must be at least 18 years of age and a resident of Canada to register as a Muwasat member. By creating a member account, you represent that you meet these requirements and that all information you provide is true, accurate, and complete.

4. Important disclaimers

  • Muwasat is a voluntary community mutual aid program. It is NOT an insurance plan. Muwasat does not guarantee any payout beyond what is collected from active members for a given case, up to the $10,000 CAD coverage limit set out in the Policy and Membership Agreement.
  • Muwasat is a registered Canadian Not-for-Profit Corporation. It is NOT a registered charity. Member contributions are NOT tax-deductible, and Muwasat does not issue donation tax receipts.
  • Muwasat does not provide funeral services directly. Funeral, burial, and related services are provided by Muwasat's licensed Islamic funeral partners (GTA) or by the family's chosen mosque or licensed funeral provider (outside the GTA).

5. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify Muwasat promptly of any unauthorized access. Muwasat is not liable for losses caused by your failure to safeguard your credentials.

6. Payments

Payments are processed through our payment processor (Clover, a Fiserv company). By submitting a payment, you authorize Muwasat to charge the payment method you provide for the relevant amount (the $200 CAD registration fee, $50 CAD per-event contributions, or any other amount you authorize). All fees and contributions are denominated in Canadian dollars. Per the Policy and Membership Agreement, registration fees and past contributions are non-refundable.

7. Acceptable use

You agree not to: (a) use the website for any unlawful purpose; (b) attempt to access areas of the website you are not authorized to access; (c) interfere with the website's operation or security; (d) submit false or misleading information; (e) use automated means to access the website without our prior written consent; or (f) infringe Muwasat's intellectual property rights.

8. Intellectual property

All content on the website — including text, graphics, logos, and the Muwasat name and brand — is owned by Muwasat or licensed to Muwasat and is protected by Canadian and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

9. Disclaimer of warranties

The website and all content are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by applicable law. Muwasat does not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of liability

To the maximum extent permitted by applicable law, Muwasat, its Board members, officers, employees, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the website or your membership in the program, including but not limited to costs exceeding the $10,000 CAD coverage limit, emotional distress, or any consequential expenses associated with a death in your family. Muwasat's total aggregate liability for any direct damages arising out of these Terms or your membership shall not exceed the total amount you have contributed to Muwasat in the preceding 12 months. This limitation does not apply to liability that cannot be excluded under applicable law.

11. Indemnity

You agree to indemnify and hold harmless Muwasat, its Board members, officers, employees, and volunteers from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law, or your infringement of any third party's rights.

12. Suspension and termination

Muwasat may suspend or terminate your access to the website and your membership in accordance with the Policy and Membership Agreement, including for non-payment of contributions, breach of these Terms, or falsification of information. Termination is effective immediately upon notice. Termination does not entitle you to any refund of past fees or contributions.

13. Dispute resolution

If you have a dispute with Muwasat, please first contact us at darmuwasat@gmail.com. Disputes regarding membership, eligibility, contributions, or benefits will be handled in accordance with the appeal process set out in the Policy and Membership Agreement. The Muwasat Board's decision on appeal is final in matters of program administration. Nothing in this section limits your right to file a complaint with the Office of the Privacy Commissioner of Canada or with any other applicable regulator.

14. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. The courts of Ontario shall have exclusive jurisdiction over any disputes arising out of or related to these Terms.

15. Changes to these Terms

Muwasat may update these Terms from time to time. Material changes will be communicated to members in writing at least 30 days before they take effect. Continued use of the website after the effective date of changes constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect.

17. Entire agreement

These Terms, together with the Privacy Policy and the Policy and Membership Agreement, constitute the entire agreement between you and Muwasat with respect to your use of the website and your membership.
